Through film, television or literature private detectives we appear endowed with extraordinary talent to solve extremely complex investigation, but what is it in reality?

From the 80s, the French detectives become "Agents private research" that collect evidence they give to their customers in the form of mission report to civil, criminal or commercial proceedings.

The Act of 18 March 2003 on Homeland Security replaces Law No. 83-629 of 12 July 1983 regulating the activities of private security and allows the French detective, "to collect, even without mentioning its quality or be subject its mission, for information or for third parties to defend their interests "in a legal framework.

When the customer says his interests to a detective, it becomes his agent and can interfere in family affairs of his client (divorce, searching for a runaway child, missing person, hijacking of a heritage etc ...). As well as in industrial or commercial matters (the fight against industrial espionage, unfair competition, flight company, employment time monitoring of employees working underground, sick abusive, etc ...).

The detective does not legally become the agent of his client, once the agreement signed and concluded under sections 1984 to 2010 of the Civil Code defines the rules and the mandate of power.

Detective will provide a detailed client report after each mission. This report will be used in court as part of the proceedings. This report will contain only elements lawfully gathered and does not affect the privacy of individuals. It is only under these conditions that the Supreme Court, according to the decree of the principle of 7 November 1962 (off Garnier), recognizes the admissibility of the report of the investigator. Since this case has never been questioned, and many jurisdictions have adopted the report to establish the presence of evidence.

Today, new technologies give researchers new ways of research and investigation, and some typical technologies that had no direct link with the detective work and activities have emerged. To clarify these legal activities, regulation was introduced to regulate the legal profession and consider it as part of the French internal security (law programming and Homeland Security 1995).

Since 2003, in order to establish themselves as professional liberal, the detective must undergo mandatory training listed in NCPR (National Directory of Professional Certification) and obtain a professional qualification (initial decree n ° 2005-1123 of 6 September 2005 on the professional qualification).

After obtaining this qualification, the detective must receive approval from the prefecture. This will assign whether legal conditions are met (as defined in the Act of 12 July 1983). The detective must have a clean criminal record (update 2) and should not and must not be included in a file of police or gendarmerie for reasons affecting the honor, honesty or morality.
